General Terms and Conditions of Sale and Use
About Us
The company Mattexcursions Sarl, with a share capital of 1,000 euros, whose registered office is located at Robert (97231), Pointe la Rose, registered with the Trade and Companies Register of Fort-de-France under number 811403310, represented by Mr. Mathieu Milard (hereinafter the Company). The Company provides the following services: SEA EXCURSIONS, boat trips with passenger vessels, whale watching, and discovery of Martinique from the coast.
Preamble
The Company invites its users to carefully read these General Terms and Conditions of Sale and Use (hereinafter the GTC/GTU). The GTC/GTU apply to all services provided by the Company to its clients within the same category, regardless of any clauses appearing in the client’s documents, including their general purchasing conditions. The GTC/GTU are systematically communicated to any Client upon request. The Client is required to read them before placing any Order. Data recorded in the Company’s IT system constitutes proof of transactions concluded with the Client.
Definitions
“Client” means any natural or legal person who places an order on this Website; “Order” means any order placed by a registered user on the Site to benefit from the Company’s services; “General Terms and Conditions of Sale and Use” or “GTC/GTU” refers to these terms; “Consumer” means a natural person acting outside their professional activity; “Professional” means a legal or natural person acting within the scope of their professional activity; “Services” means all services offered by the Company via the Site; “Site” means the present website www.mattexcursions.com; “Company” refers to Mattexcursions Sarl; and “User” means any person using the Site.
Registration
Registration on the Site is open to all legal entities or individuals of legal age with full legal capacity. Use of the Services is conditional upon registration. Registration is free. The User must complete all mandatory fields; otherwise, registration cannot be completed.
Users guarantee that all information provided is accurate and up to date. They agree to update their personal information via their account. Each registered User has a username and password, which are strictly personal and confidential. The Company shall not be liable for identity theft. In case of suspected fraud, the User must inform the Company promptly.
Each User may only hold one account. In case of breach of the GTC/GTU, including multiple accounts or false information, the Company reserves the right to suspend or delete accounts. Account deletion results in the loss of all benefits, but orders already placed will still be fulfilled.
Services and Pricing
The Services governed by these terms are those listed on the Site and provided by the Company or its partners. Services are described on their respective pages. Prices are in euros, all taxes included (TTC), and reflect applicable discounts on the day of the Order. Additional fees may apply and will be specified before checkout.
The Company reserves the right to modify prices at any time but will invoice based on the price applicable at the time of the Order. If the price cannot be determined in advance, a quote will be provided.
Orders
Orders can only be placed by registered Users. The User selects Services, reviews their cart, and confirms the Order by clicking “Order”. The User must provide address, delivery method, and payment details.
Order validation implies acceptance of the GTC/GTU and constitutes proof of the contract. A confirmation email will be sent summarizing the Order.
In case of non-payment or issues, the Company may suspend the Order. If a service cannot be provided, the Client will be informed and refunded. Cancellation less than 5 days before the service (except force majeure) may result in a 50% retention of the pre-tax amount as compensation.
Payment Terms
Unless otherwise stated, payment is due in full at the time of Order. Payment methods include cash and credit card.
Late payments by Professionals incur penalties based on the European Central Bank rate plus 10 points. A fixed fee of €40 applies for recovery costs. Consumers incur penalties based on the legal interest rate.
Service Delivery
The Company undertakes to provide the service within the agreed timeframe but is not liable for delays beyond its control. If services are not delivered on time, the Client may request cancellation and a refund within 14 days.
Complaints
The Client has 14 days from service delivery to file a complaint via email at mattexcursionsnautiques@gmail.com. Valid complaints may result in replacement or refund.
Right of Withdrawal
The Consumer has a 14-day withdrawal period, except for services listed under Article L221-28 of the French Consumer Code. Refunds are processed within 14 days using the original payment method, minus any services already performed.
Personal Data
Registration involves processing personal data in compliance with GDPR (EU Regulation 2016/679). The Client has rights to access, modify, or delete their data by contacting the Company.
Data Sharing
Third parties may access data strictly for operational purposes. Users may receive promotional content but can opt out at any time.
Data Protection
The Company implements appropriate security measures but does not guarantee absolute security.
Cookies
The Site may use cookies to enhance user experience. Users can manage cookie preferences through their browser settings.
Modifications
The Company reserves the right to modify the Site, services, or terms at any time. Applicable terms are those in force at the time of the Order.
Liability
The Company is not liable for Site downtime or delays beyond its control.
Intellectual Property
All Site content is protected by intellectual property laws. Unauthorized use is prohibited.
Jurisdiction
These terms are governed by French law. Disputes will be subject to competent courts after an attempt at amicable resolution.
Pre-contractual Information
The Client acknowledges having received all required information prior to ordering, including service details, pricing, and withdrawal rights.
